In November 2015, a nursery rhyme named’baby shark’ was uploaded on YouTube.
So far, only 8.1 billion views.
It is the number one YouTube view in the world.
It was sung in various places, including military and TV shows, while garnering worldwide attention.
In fact, the original song of’Baby Shark’ is a foreign oral nursery song that has been handed down for a long time.
But two years ago, an American nursery rhyme composer filed a lawsuit against the Seoul Central District Court that Pinkfong’s’Baby Shark’ plagiarized his song.
As a result of the JTBC interview, the Korean Copyright Commission recently concluded that Pinkfong’s song was not plagiarism.
First of all, listening to the oral nursery rhymes and the two songs, the Copyright Commission first saw that the American nursery composer’s’Baby Shark’ had little creativity compared to the oral nursery rhymes.
He explains that starting with a disco style with drums or accompaniment, adding guitar and chords is also a popular method.
The Copyright Commission also said that Pinkfong’s’Baby Shark’ is different from the song of an American composer who claims copyright.
The chords and accompaniment genres are different, and there is no way to put a’half key’ in the second half.
The Copyright Commission has concluded that there is no similarity when comprehensively considering rhythm and harmony centering on rhythm.
Although the results of this appraisal do not immediately conclude the lawsuit, expert appraisal in a copyright lawsuit has a very decisive effect.
