Controversy is arising as Hana Tour, the No. 1 travel industry, has taken measures equivalent to the standby order for employees who are currently on leave. Some of them were suggested to resign, but it was confirmed that they refused to resign, and claims that the management is pressing the resignation by telegram.

“Awaiting team issuance” to employees on leave

According to the Hana Tour Union (Chairman Park Soon-yong) on ​​the 4th, on the 3rd, the headquarters of Hana Tour appointed more than 60 employees as the’Human Resources Waiting Team’. Excluding the 200 required manpower, 2,100 Hana Tour employees are all on unpaid leave.

The Human Resources Waiting Team, under the jurisdiction of the head office’s Human Resources Department, previously belonged to dispatched workers, maternity leave, leave of absence, and those subject to disciplinary action. It was a department where employees go through briefly to recruit manpower to departments where vacancy is expected.

However, the union pointed out that the head office’s appointment of personnel is in a different form than before. Previously, there was a reason for the department change, so the parties were aware of the reason for the issue, but this time it is not.

Regarding the reason for the announcement of personnel appointment, the management provoked a clue that “reviewing the placement of appropriate departments in consideration of the business environment after being selected as a department under the HR department due to the reorganization of the business area”, but did not specify the deadline for relocating the department.

According to a survey conducted by the union, some of the 60 employees were the targets for which the management’s manager suggested resignation in January, and did not submit a retirement agreement. The heads of Hana Tour headquarters (upper divisional concept) sent an e-mail in January asking some employees to pay consolation money and retire. The union’s accounting audit was also included in this waiting team.

Chairman Park Soon-Yong criticized “I cannot understand the management that made unilateral work adjustments for those who are not subject to disciplinary work, those who are on postpartum leave, or those who are not on leave during the period of unpaid leave.”

Hana Tour explained, “Not all people who did not agree to retire were appointed to the standby team.”

Song Hyun-ki, a certified labor attorney (labor firm Samshin), said, “When we compare the business necessity and the disadvantages of the workers (in relation to this appointment), we can judge the legitimacy of the telegram. “It is unfair to issue personnel to an ineffective department even though there is no business necessity at the office, and there is room for reading as a result of restructuring pressure.”

The Tourism and Service Labor Union argued that “Hanatour is putting pressure on employees to layoffs in the face of recommended resignation.”

Since last year, Hana Tour has transferred its employees to a subsidiary or transferred to a department that is not related to the existing business. <매일노동뉴스>On July 1 of last year, Hana Tour’s personnel appointment notice, secured by the company, changed 187 employees who belonged to the travel products department or local branch to belong to the call center.

Those (operators) who were in charge of sales at local branch offices were also appointed as call centers with offices in Seoul. Operators received an e-mail from the head office official in January stating, “As of April 1, the agency call center support service has been transferred to the subsidiary, Hana Tour List, so please consider carefully about your location.” It was a notification that the salary system was changed as the work place was changed to Seoul, and at the same time, it was transferred to Hana Tour List, a subsidiary.

Chairman Park said, “Those who are eligible for call center telegrams have to choose whether they are from a subsidiary or if they will move around overnight,” he said. “There is no space for personnel of this size at the headquarters in Seoul, and the changed pay system is unfavorable to workers. Conditions”.

“Hana Tour, social criticism”

Some of the employees were informed of their resignation from the general manager in January. The e-mail written in the name of the head of the division said, “We are optimizing the organization,” and “Employees affected by the efficiency of workforce will pay condolence money.” Employees who consented to resignation wrote a retirement agreement, and the first sentence of the retirement agreement contains the phrase “This agreement was signed between Hana Tour Inc. and the employee.” However, the management denies that it is still not restructuring at the headquarters level.

The union criticizes that Hana Tour is taking steps to reduce manpower to target the blind spot of the law while not complying with the dismissal procedure for management reasons pursuant to Article 24 of the Labor Standards Act. The law does not impose restrictions on restructuring or hopeful retirement based on labor-management agreements rather than layoffs where employers unilaterally order dismissal.

An official from the Ministry of Employment and Labor said, “The desired retirement itself is not illegal, but if you are forced to resign, you can report it to the Labor Office.” It is the same.”

Vice-Chairman Cho Seung-won said, “Most did not know that employees who agreed to resignation could refuse retirement because they were in a situation where they had to choose between transferring or retiring from a subsidiary.” In addition, even if the management claims that the legal process was followed, it should be socially reproached.” Vice-Chairman Cho said, “We will share the seriousness of the Hana Tour situation with the members of the National Assembly’s Environmental Labor Committee and find a solution.”
