Lee Jae-yong, vice chairman of Samsung Electronics, was handed over to trial on charges of bribing former President Park Geun-hye and others in the name of asking for management succession.

The first trial court sentenced Vice-Chairman Lee to five years in prison in August 2017.

The sentence is inevitable as 8.9 billion won, including support for horseback riding to Seowon Choi’s daughter, Yura Jung, is recognized as a bribe.

However, the judgment of the second trial court on the amount of bribery was different.

Only 3.6 billion won was reported as a bribe, excluding the cost of purchasing Jeong’s horses, and sentenced to probation.

Vice-Chairman Lee was released almost a year after being imprisoned in a detention center.

The Supreme Court, however, saw a problem with the second trial ruling over the amount of bribery.

The case was sent back to the law, saying that 5 billion won, including 3.4 billion won in purchase of three horses and 1.6 billion won in sponsorship of the Winter Sports Gifted Center, should also be viewed as bribes.

Vice-Chairman Lee determined that all the money he gave as bribes by embezzling Samsung Electronics funds was 8.6 billion won.

In this way, if the amount of embezzlement exceeds 5 billion won for business purposes, you are basically imprisoned for at least 5 years.

Imprisonment sentences of three years or more cannot be probated.

According to the law, a sentence of imprisonment for Vice Chairman Lee is inevitable, but the variable is the discretion of the judge.

This is because, if the judge determines that there is a reason for’consideration’, the sentence can be reduced to half of the court sentence.

The possibility of a probation cannot be ruled out after the court lowers the sentence of Vice-Chairman Lee to two years and six months to three years.

In particular, the Samsung Compliance Committee recommended that it be reflected in sentencing if the remand and remand court judge shows the will to manage compliance.

Between the sentence and the probation, attention is being drawn to what the judge will give.

Vice-Chairman Lee arrived 20 minutes before the trial began.

I went to court without giving any answers to reporters who asked about their feelings about to be sentenced.

Vice-Chairman Lee has been arrested on charges of bribing former President Park Geun-hye and Choi Seo-won, who are “unsounded”, for help with the succession of Samsung Group’s management rights.

At the first trial, she was sentenced to five years in prison, and at the appeal trial, the amount of bribery was recognized as low, so she was sentenced to two years and six months in prison and four years in suspension.

However, in August of last year, the Supreme Court returned the case to the High Court, saying that the three horses Samsung handed over to Seo-won Choi should be regarded as bribes, including 3.4 billion won and 1.6 billion won for the Winter Sports Gifted Center.

Last month, at a hearing on the decision to revoke and repatriate, a special prosecutor called for nine years in prison, saying that Vice Chairman Lee actively bribed former Presidents Park and Seo-won Choi for succession of management rights.

In response, Vice-Chairman Lee refuted that bribery could not overcome former President Park’s coercion, and Vice-Chairman Lee also appealed in his concluding statement saying that everything was his fault.

If more bribes were granted, wouldn’t this increase the likelihood that Vice Chairman Lee would be jailed again?

According to the Supreme Court’s purpose of revocation and repatriation, Vice-Chairman Lee’s bribery will increase dramatically from 3.6 billion won to 8.6 billion won.

If the charges of embezzlement of the money are applied, the court sentence is “a sentence of arms or imprisonment of 5 years or more”.

However, if there are reasons for the court to take into account, the sentence may be lowered.

Vice-Chairman Lee’s claim that he gave bribes because he was unable to overcome the coercion,

In addition, it may be reduced if the court approves the effectiveness and sustainability of the Samsung Compliance Monitoring System.

If the sentence comes out and Vice-Chairman Lee is imprisoned again, Samsung will face a vacancy again after three years.

On the contrary, if a probation comes out, there will be criticism of the sentence of’looking after the chaebol’ again, so whatever the outcome, it seems inevitable.
