From 2:05 pm, the Seoul High Court will hold a trial for the destruction of Vice Chairman Lee Jae-yong who has been handed over to the trial on charges of bribery.

It has been 1 year and 5 months since the Supreme Court sent back in August of last year to re-trial the case of Gukjeong Nongdan, including Vice Chairman Lee.

In February 2017, Vice-Chairman Lee was arrested on charges of bribing former Presidents Park Geun-hye and Choi Soon-sil for help with the succession of the Samsung Group’s management rights.

He was sentenced to five years in prison at the first trial, but the following year, the amount of bribery was recognized as low at the appeal trial, and he was released after two years and six months in prison and four years probation.

However, in August 2019, the Supreme Court returned the case to the High Court, saying that at the time of Gukjeong Nongdan, Samsung should pay the price of three horses to Choi Soon-sil and 1.6 billion won in support of the Winter Sports Gifted Center as a bribe.

At the decision hearing last month, the special prosecutor asked the court to sentence him to a severe sentence of nine years in prison, saying that Vice-Chairman Lee actively bribed him to take over management.

However, the Samsung side protested that it was unavoidable to give money to him because it was unable to overcome the coercion of former President Park Geun-hye, and Vice-Chairman Lee also appealed in the final statement, saying that everything was his disrespect and fault.

If the amount of bribery increased, wouldn’t this increase the likelihood of Lee’s being jailed again?

Yes, according to the purpose of destruction and repatriation, Vice Chairman Lee’s bribery amount will increase to 8.6 billion won, and if the charges of embezzling his money are applied, he will be sentenced to life or more than five years in prison.

It can be said that the possibility of reincarceration has increased as the Supreme Court has virtually determined whether the person is guilty or not guilty, but it is up to the court to decide the sentence.

If vice-chairman Lee’s claim that the bribery was passively paid or the effectiveness and sustainability of the Samsung compliance system, which caused noise throughout the destruction and repatriation, are recognized as factors for commuting, a probation may be issued.

The court ordered Vice Chairman Lee to conduct compliance management from the beginning of the remand hearing, and said that if it was operated effectively, it would be reflected in the sentencing system.

The special prosecutor protested by filing an application to evade the court, saying that he expressed his intentions to sentence him to probation.

Vice-Chairman Lee established and operated the Samsung Compliance Monitoring Committee in response to the request of the court, and also apologized to the public.

If Vice-Chairman Lee is imprisoned again, Samsung will face a vacancy again after three years.

On the other hand, if a probation comes out, there is a high possibility that the criticism of being sentenced to’care for the chaebols’ is likely to follow.
