For the first time as a judge, Im Seong-geun, the head judge of the Busan High Court, ended his term of office yesterday (28th).

As of today, I am a former judge, but the preparation process for the impeachment trial has not yet been carried out, so I am interested in how the Constitutional Court will tie the knot.

Deputy Judge Im Seong-geun, who took off his legal uniform amid the disgrace of the first judge’s impeachment proceedings, remained silent on charges of intervening in the trial until the last day of his term.

Two days before my retirement, I posted an article saying that I asked for forgiveness from a person who was afflicted by the court’s internal network and suffered pain or discomfort because of her, but there was no mention of the impeachment prosecution.

At the end of the senior judge’s term of office, the unprecedented judgment of impeachment of the incumbent judge is now against former judges.

The Constitutional Court delayed the first pleading preparation procedure, which was scheduled last Friday, when Deputy Chief Judge Lim applied to evade Constitutional Judge Lee Seok-tae, the referee for the impeachment trial.

Judge Lim’s side is considering the history of Judge Lee as chairman of the Special Investigation Committee for the Sewol ferry disaster in 2015 and as chairman of the bar association for a democratic society.

It is difficult to expect an impartial judgment as the reasons for the impeachment prosecution include the so-called’Seven Hour Suspicion of the Sewol ferry’ by former President Park Geun-hye and the fact that he was involved in a civil-byeon-related trial.

As early as this week, the Constitutional Constitution is expected to set a deadline for the preparatory process again after reaching a conclusion on the challenge.

Even if the request for evasion is accepted, it is expected that the effect on the impeachment trial will not be very significant, as only eight people excluding this judge will have to hear.

However, as Judge Lim is no longer judged as a judge, but as a natural person, the possibility of the Constitution dismissing the impeachment case remains.

Judge Lim, who previously responded to the allegations of intervening in the trial, stating that there was no serious violation of the law, is also likely to reinforce the claim that the term of office has already ended and there is no real benefit of impeachment.

However, even for former judges who have already retired, there are observations that the Constitution will come up with a judgment on unconstitutionality in some way considering the seriousness of the case.
