Eight years ago, a gynecologist who had an abortion was found acquitted in the Supreme Court.

This is the first time that after the Constitutional Court’s decision was made unconstitutional, an abortion procedure was conclusive.

The Supreme Court ex officio acquittal of A, a gynecologist, who performed an abortion on a single mother in the fifth week of pregnancy in 2013.

In the first and second trials, the sentence was suspended even considering Mr. A’s reflection and the unwed mother’s poor health.

The Supreme Court ruling overturning this was in accordance with the Constitutional Court’s decision on abortion inconsistency.

This is because provisions that are determined to be unconstitutional are retroactively invalidated.

Prior to this, the Constitution ruled inconsistent with the Constitution on Article 269 (1) Self-Abortion and 270 (1) Medical Abortion in the Criminal Code in 2019, and gave a deadline for alternative legislation until December 31, 2020.

The crime of abortion is to protect the life of the unborn child, but it was unconstitutional to ban women’s right to self-determination, and the legislature was intended to exercise discretion.

However, with no alternative legislation and abolition of abortion from this year, confusion is expected to inevitably.

The government’s amendment divides the timing of abortion into three stages, allowing it to be fully allowed until 14 weeks of pregnancy, and 15-24 weeks to allow sexual assault, relative pregnancy, and health threats of pregnant women through expert consultation and a 24-hour meditation period. .

The women’s world is against the government, asking for full permission, the religious world against the abolition, and the medical community with more stringent standards.
