The Constitutional Court started the hearing on the case of Deputy Chief Judge Im Seong-geun, which was impeached for the first time in the history of the constitution as a judge.

On the 26th, two days before Judge Im’s retirement, the first pleading preparation date will be held and the hearing schedule will be arranged.

Deputy Judge Lim Seong-geun was charged with intervening in the trial of the Seoul branch director of the Sankei Shimbun, who was accused of defaming former President Park Geun-hye.

Although he was acquitted at the first trial, it was found in the judgment that the unconstitutionality of the act of Judge Lim was recognized, and the National Assembly submitted a bill of impeachment to the Constitutional Court.

On the 26th, 22 days after receipt of the case, the Constitution decided to proceed with the date of preparation for the pleading at the 2:00 p.m. judgment of the sub-trial, and informed the schedule to the prosecution committee of the National Assembly and Judge Lim.

The preparatory date for pleading is a procedure in which the adoption of witnesses or evidence, schedules and issues, etc. are arranged for an efficient trial before the pleading date.

The preparation period may end once on the day, but may be added as needed.

Judge Lim said in the call with YTN that the parties do not need to be present in person, but they will consider attendance a little more because only the person knows may be discussed.

In addition, he explained that the preparatory date will emphasize the fact that Judge Lim has not committed any serious constitutional violations.

The representatives of the National Assembly also pointed out whether Judge Lim violates the law and whether it is the legal interest of the impeachment trial related to retirement.

At the same time, he explained that he would prepare a claim on the necessity of impeachment and proof of the facts that were resolved through a meeting of the delegation.

Judge Lim’s term of office ends on the 28th, two days after the first preparation period.

If you retire prior to the constitutional decision, the impeachment claim may not meet the legal requirements and may result in a dismissal decision.

However, even if the Constitution is dismissed, the Constitution’s decision may contain the judgment as to whether the Constitution is violated.

After the preparation process is over, a hearing will be conducted through public pleadings, and the final decision of the Constitution will be made after the final statement of opinion is completed.
