[단독]Female elementary school students riding bicycles in Gyeongju School Zone, sentenced to 1 year in prison

Unwritten intentional recognition… Victim attorney “A judgment that meets the purpose of protecting children”

A woman in her 40s chasing an elementary school student riding a bicycle with her vehicle in the Gyeongju Children’s Protection Area (school zone) in Gyeongbuk, was sentenced to one year in prison at the first trial.

◆Crashed behind an elementary school student on a bicycle, but claimed to be “not intentional”

Daegu District Court Gyeongju Branch Criminal 1 (President Judge Choi Hae-il) sentenced Mr. A to 1 year in prison, claiming that he was admitted to a special injury under the criminal law. Mr. A has been investigated for colliding 2nd grader B, who was riding a bicycle with his sports utility vehicle in a school zone near an elementary school in Dongcheon-dong, Gyeongju at around 1:38 pm on May 25 last year. Mr. A got out of the vehicle right after he struck Army B and attacked Army B.

The group B family claimed that “Mr. A came after him saying’I hit my child and not apologized’ and made an accident on purpose.” However, Mr. A has always denied intentional accidents. In the course of chasing Army B, he also made illegal U-turns and reverse driving, but this was a legitimate act in the process of chasing Army B who harmed his daughter on the playground. They also claimed that Army B was out of sight just before the crash.

◆Gukgusu “was intentional” conclusion… Free from arrest

However, the court admitted to Mr. A an unwritten intention. Previously, the National Forensic Research Institute proved that Mr. A’s deliberate possibility at the time of the accident through field verification and black box/closed circuit (CC) TV image analysis was also a decisive basis. Gukkosu said that Mr. A accelerated the vehicle from 12.3km/h to 20.1km/h just before colliding the bicycle of group B, and that when the scene was reproduced with special glasses (vision cam), group B was seen from the car of A. Considering that, we concluded that Mr. A was intentional.

Mr. A was sentenced to one year in prison, but he was not arrested immediately. The court decided that Mr. A had three children to take care of, and that he had room to reach an agreement with Army B, and ordered him to be sentenced to jail after his sentence was finally confirmed.

Ji-Seok Buo, a lawyer at the law office who served as the legal representative of Army B, said, “In order to raise awareness about the damages of children’s traffic accidents and block risk factors, a civil law was enacted last year to severely punish negligence in the school zone.” Is a case in which an adult inflicted injuries intentionally, not negligently, to a protected child, and this court ruling is a valid judgment that fits the purpose of the recent legislation.”
