The Supreme Court delivered an opinion to the National Assembly on the 2nd, stating that “impeachment of judges is the authority of the National Assembly and the Constitutional Court” regarding the movement of the politics to impeach the head of the Busan High Court.

According to an answer submitted by the Office of the People’s Strength Kim Do-eup, an opposition party secretary of the National Assembly Legislative Judicial Committee, the Supreme Court said, “The National Assembly and the Constitutional Court have authority over the impeachment proceedings, and it is not appropriate for the Supreme Court to state its position.” The Supreme Court added, “We are seriously aware of the current situation in which discussions to promote impeachment against judges are underway.”

The previous day, together with the Democratic Party, Justice Party, Open Democratic Party, and Basic Income Party, 161 members of the Beomjinbo camp initiated an impeachment prosecution against Judge Im. The number of legislators named on the impeachment bill exceeded the quorum (151) for passing the National Assembly.

The reason for the impeachment prosecution was the suspicion that the former President Park Geun-hye intervened in the trial of former Seoul bureau chief Tatsuya Kato, Sankei Shimbun, who was accused of defaming the “Seven Hours of the Sewol”. Judge Lim was acquitted at the first trial, but the sentence contained the expression “(Judge Im’s) involvement in the trial is unconstitutional.” The Democratic Party argues that “unconstitutionality has been recognized.”

This is the first time in the history of the constitution that the National Assembly proposed impeachment proceedings against a first-line judge, not a Supreme Judge. Regarding the official position of the Supreme Court, which emerged from this situation, the opposition party criticized “the Supreme Court is consistent with a passive response because it tamed the judiciary of passports.”

Rep. Kim Do-eup said, “The impeachment of judges is likely to be abused to make judgments against the government or the ruling party or to oppress judges who do not suit their tastes. It is also a problem that the Supreme Court, which has to deal with the infringement of jurisdiction, is bystander .
