Software companies that were very nervous took a breath. This is because the U.S. Supreme Court ruled that the use of’Java API’ when developing Android was fair use.

The U.S. Supreme Court gave Google a hand in the 10-year war in Java on the 5th (local time).

There were two main issues of the ruling on this day.

first. Is the Java API also copyrighted?

second. Can Google use the Java API as fair use?

Up to the Court of Appeals, both issues have served Oracle’s hand. In particular, the first issue was accepted as having great significance in terms of expanding the scope of software copyright recognition.

The problem was the second part. API is like a core tool used in software development. This is because there was a possibility that software developers could be hit hard if fair use was not recognized.

In fact, shortly after the U.S. Federal Court of Appeals ruled against Google’s use of Java APIs against fair use, software companies were very nervous. This is because the after-storm is not easy.

The API is an important part that defines the function of the software. Therefore, it is considered one of the key materials of modern technology. Accordingly In Silicon Valley, even if Oracle wins the final victory, the prospect of a new Java API tax could be created.

However, with the Supreme Court ruling on that day, these concerns can be cleared.

Supreme Court Justice Stephen Briar said in a ruling that day, “In this case, Google took only as much as necessary for users to create a new modified program and re-executed the user interface. Therefore, it is fair use that Google duplicated the Sun Java API.” And wrote.

According to the IT media protocol, the Supreme Court finally gave Google a hand while reviewing four factors.

first. Purpose and characteristics of use.

second. The nature of the work.

third. The amount and persistence used throughout the work.

fourth. Hyogo that the use of copyright affects the potential market or the value of the work.

As a result of reviewing the case based on these four criteria, the Federal Supreme Court finally ruled that Google’s use of Java APIs in Android development is subject to the copyright law’s disclaimer under’fair use’.

In response to the ruling, Google commented, “The Federal Supreme Court’s ruling is a big win for innovation, compatibility, and computing.”

■ Supreme Court ruled that’fair use is deserved when considering alternative API development costs’

The Supreme Court’s ruling today noted that API recycling benefits both software developers and consumers.

Judge Briar said in a ruling that day, “Considering the cost and difficulty of creating other APIs (in lieu of the Java API), the Sun Java API code (if you accept Oracle’s argument) is limiting the creativity of the future of new programs. “It could be a lock,” he said. “In that case, only Oracle will have the (future) key.”

In fact, if the Supreme Court gave Oracle the hand, it could have had a huge impact on modern software development, especially in cloud computing, the protocol analyzed. Cloud computing is mostly implemented through APIs.

In particular, the protocol pointed out that “Oracle also duplicated Amazon Web Services’ S3 API when creating cloud services.”
