Naver will be applied to the Netflix Act (amendment to the Enforcement Decree of the Telecommunications Business Act) for the fourth time after Google, Wave, and Daum.

On the 26th, an official from the Ministry of Science and Technology and Information and Communication said, “Naver, which has recently encountered a service error, is subject to the Netflix Act,” and said, “We have requested to submit data to determine the exact cause of the failure.”

Regarding the possibility that this error may be the effect of a Distributed Denial of Service attack, he said, “It is not confirmed yet.”

However, Naver announced the day before that it was “due to a DDoS attack” regarding the cause of some service access failures on the 24th. A Naver official said, “As a result of the analysis of the cause of the service error, it is correct that a large-scale DDoS attack was performed.”

The Netflix Act imposed an obligation to maintain quality so that content providers can provide stable services, and it has been enforced since December of last year. The law applies to value-added telecommunications service providers whose daily average number of users and traffic volume is more than 1 million each and 1% or more of the total traffic volume in Korea for three months at the end of the previous year.

In Korea, operators such as Google, Facebook, Netflix, Naver, and Kakao are applicable.

Designated operators are obligated to △prohibit discrimination against telecommunications business operators △preparing for technical errors and excessive traffic △information of contact information for consultation to users related to service interruption. Corrective orders or fines are imposed in some cases, such as whether the obligations have been properly fulfilled.

After receiving the data from Naver, the Ministry of Science and ICT plans to check the cause of service errors and whether or not to ensure stability. If there is intentional negligence or negligence, a corrective order, etc. will be issued.

Even if the cause of this service error is due to a DDoS attack, it is expected that user compensation is practically difficult.

In the case of the current supplementary telecommunication service, the standard time for compensation for service failures is set at 4 hours, so there is no remedy. The Naver error is estimated to be disabled for less than 4 hours.

Regarding the delay in identifying the cause of the failure, a Naver official said, “First of all, resources were put into service error recovery, and then the cause was identified.” We have taken measures to send them,” he said.

Earlier, Naver had some service failures from 5:26 pm on the 24th. News, blogs, and cafes in service were not accessed due to this disorder. Most of the service was restored at 7 pm, about 1 hour and 30 minutes later, but users suffered inconvenience due to extensive service disruption.
