According to the Labor Standards Act, writers who wrote news manuscripts for several years in the (MBC) Press Bureau were found to be workers under the Labor Standards Act. It overturned the decision of the Local Labor Committee (Ginowi) who viewed the two writers as’freelancers’. This is the first time a broadcaster has been recognized as a worker under the Labor Standards Act. Both Kim Amugae and Lee Amugae, who filed for relief from unfair dismissal, were fired in June last year for “renewing people for the program reorganization,” after working as writers in the morning news program of cultural broadcasting since 2011. . The two writers filed an unfair dismissal request to Ginowi, claiming that “I worked like a full-time worker because I was in charge of constant work in cultural broadcasting for the past 9 years,” but Ginowi rejected the application. He accepted the argument from the cultural broadcaster that “the two writers are freelancers with a contract for delegation of work,” and decided that they were not eligible to argue whether or not the dismissal was unfair. The two writers filed an application for reconsideration in objection to the decision of Ginowi. Earlier, Ginowi decided that cultural broadcasting did not apply employment rules and personnel regulations to writers, and that writers could not be viewed as workers under the Labor Standards Act because discretion and independence were recognized in the performance of work. Although the writers commuted to a certain place at a certain time every day, I saw it as “according to the characteristics of live broadcast news.” The claim that it was subordinated to the work orders of regular PDs of Cultural Broadcasting also accepted the company’s position that “consultation is inevitable due to the nature of the broadcasting programs led by PDs.” However, during the reconsideration held on the afternoon of the 19th, the middle-aged and senior citizens emphasized the superior position of cultural broadcasting. △To what extent cultural broadcasting staff direct and supervise the writers in the process of writing a news manuscript △The nature of the compensation that writers receive is predictable and fixed.
