In the case where a full-term pregnant woman of Cambodian nationality died in a car accident and left insurance money of 9.5 billion won, the Supreme Court finally found her husband’s murder charges innocent.
According to the legal community on the 18th, the second part of the Supreme Court (Presiding Judge Noh Jeong-hee) confirmed the court case in acknowledgment of the charges of fraud related to murder and insurance claims in a reappeal against Mr.
In addition, under the Special Act on Traffic Accident Handling, he admitted guilty only to the charges of lethality, and confirmed the court case sentenced to two years in imprisonment.
In August 2014, Mr. A was handed over to trial for driving his van near Cheonan IC on the down line of the Gyeongbu Expressway and hitting a stationary 8t truck. The seven-month pregnant wife who accompanied him at the time died in this accident.
During the investigation, Mr. A is known to have stated that he did not see the truck while driving while driving. Before the accident, the prosecution conducted an investigation into the fact that Mr. A had purchased insurance worth 9.5 billion won in front of his wife.
The first trial sentenced him to acquittal, saying that indirect evidence against Mr. A would not prove the crime. However, the second trial convicted Mr. A and sentenced him to life imprisonment. After that, the Supreme Court returned the case to the lower court with the innocence of “the motive for the murder is not clear” in the appeal. After a three-year hearing, he was found not guilty of murder and fraud, and guilty of mortality under the Special Act on Traffic Accident Handling.
