Earlier, Medytox claimed that Daewoong Pharmaceutical had stolen its Botox strain and process technology and filed a complaint with ITC to ban exports to the United States. The reason is that it hurts the profits of Allergan, an American company preparing to market in the US by importing Medytox products. The ITC partially admitted the theft and decided to ban Daewoong Pharmaceutical’s products from being imported into the US for 21 months.

Daewoong Pharmaceutical said it plans to appeal to the Federal Circuit Court of Appeals this week. In particular, last month, some of Medytox’s Botox products were revoked from the Korea Food and Drug Administration for the reason of’manipulation of safety evaluation data’ and were subject to a ban on sales. Daewoong Pharmaceutical said, “There must have been data manipulation in the US clinical trial process as well,” and said, “We plan to petition the Food and Drug Administration (FDA) to investigate this fact.”

In response, Medytox said, “Even if Daewoong Pharmaceuticals appeals, there is little possibility that the charges determined guilty through evidence will change.”
