Some of the trials were attended directly, but due to the nature of the case, the trials were often held privately. In this case, the situation at the time of the trial was recorded through a lawyer representing the victim child. At the request of the victim child’s family, the date, location, and details of the crime will not be disclosed. However, even before the final conviction, the artist’s real name was disclosed. 301, Beopjeong-dong, Suwon District Law, at 2 pm on December 3, last year. It was the day of the sentence of the 15th criminal division (Judge Cho Hyu-ok). The presiding judge, who had previously sentenced two cases, began the sentence of Han Ye-chan, 53, a children’s fairy tale writer, who was charged with harassment (violation of the Sexual Violence Penalty Act), including hierarchic under the age of 13. Han, wearing a white shirt and a navy jacket, sat in the front row of the court and heard the sentence of the judge. Mr. Han said that since the first trial, which began in July 2018, there has been no harassment by force. It was argued that “according to the will of a child with whom he has a close relationship, he has skinned things such as kissing his lips or hugging naturally.” The judge’s judgment was different. “The victim’s statement, who was 11 years old at the time, was consistent and realistically expressed characteristic parts that were difficult to make up without firsthand experience. In particular, putting a tongue in the mouth and a simple kiss were clearly distinguished, and the difference in feeling was also specifically expressed in the investigation process. Above all, even though there were 27 crimes, the time, place, and content of the damage were clearly separated and stated.” He also admitted that there was power in the assault process. The court judged that Han, who played the role of a teacher, such as essay class and outdoor experience activities, used this relationship to harass him. “It seems that the teacher and the child used the psychological and emotional relationship of trust to commit harassment. In light of the differences in status, age, and physique between the accused and the victim, it seems to be sufficient to subdue the victim’s free will. … It is very unconvincing to see that the victim’s consent to kiss or hug a victim of an elementary school student who is easy to comply with education. It has no choice but to be seen as an abnormal behavior that takes advantage of the ignorance and status difference of a young victim who has no dating experience.” The court sentenced Mr. Han to two years and six months in prison and imprisoned him in court. He also ordered a 40-hour sexual violence treatment program and a 3-year employment ban at institutions related to children, adolescents and the disabled. Han said loudly to the court. “I have never violated human rights and have never treated children with care. Despite the evidence against me, I think it was a false ruling made by the prosecution and the judiciary in connection with the Me Too case without taking this into account. Han appealed against the judgment of the first trial. The prosecution, who judged that the sentence was small, also appealed.

Pain left after first trial conviction

Although he was convicted at the first trial, the parents of the victim were not comfortable. This is because there are books written by Han Ye-chan everywhere. “The children went to the local public library, and my younger brother took out his book and asked if he could read this book. I want to live by asking everything as if nothing had happened. But I shouldn’t stop his books and nursery rhymes from being exposed to children.” In the website of the National Library for Children and Youth, 94 books and 38 e-books are searched under the name of Han. 675 books are also searched in the integrated website for 16 children’s libraries belonging to the Seoul Office of Education. Of these, 148 are on loan (as of 14 days). I searched for a book written by Mr. Han at the Kyobo Bookstore website. 86 books for children (elementary school), 24 sets of children’s books, 2 books for infants, 25 e-books, 3 books related to religion, and 5 albums containing children’s songs written by him are searched. Some are out of print and sold out, but many are still sold.

Mr. Han mainly wrote fantasy history for elementary school students. The fantasy series featuring a girl named’Seo Yeon’ raised in a single parent family is Han’s masterpiece. “It is a very popular book among children,” said the victim’s father. The child asked my mother to buy it, so I bought it.” There are 175 series of books in 16 children’s libraries of the Seoul Metropolitan Office of Education. Of these, 85 books are so popular that they are loaned out (14 days). In the Kyobo Bookstore website, “My child likes Seoyeon’s series a lot.” “I bought the series because my child liked it.” “My 9-year-old girl read it all in one day.” “My 3rd daughter is a fan of Seoyeon’s series. I’d like to buy another series, too,” and so on. In the’Tinteen Romance Series’ written by Han, there is a story of’love’ between adults and minors who have returned as children. Han published just before he was charged with child molestation. After eating magic chocolate, a teenage female protagonist wishes to be the same age as her favorite job-ready brother. It is a story where the female protagonist becomes a grown-up, but the older brother becomes a teenager, confirming each other’s hearts.

He used a fantasy form that appeared at the time of trial to deal with the love of minors and adults. Popular high school boys will like high school girls with white skin enough to be nicknamed’Milk Girl’. It turns out that this high school girl was a 36-year-old woman who went to the world 20 years ago for 99 days through a necklace bought on the street. Han also wrote sex education books for girls aged 10-11. The revised version in 2014 is titled’Sex Education Growth Fairy Tale for 10–11 Year Old Children’. ‘I’ll buy you a cell phone”You can’t be alone!’ ‘Do not touch!’ It contains guidelines for preventing sexual violence in children. Han’s 43 books are still on sale at the Gamunbi website, a children’s book publishing company that published most of Han’s books, even after the first trial was convicted. The series, which is a fantasy history, has explanations such as’Linking to the subject of Unit 1 in the second semester of the 5th grade of elementary school.’ Mr. Han is said to have worked with this publishing company for over 10 years. Asked the spouse’s side when they knew that Han was the target of the investigation. The publisher side replied with the effect that it became known from September 2018 when the victim child side applied for Han’s imposition seizure. “I only knew that I was involved. The details are the author’s private life, so it is difficult to ask skewers.” As for the reason for the publication of nearly 20 new books even after Han was charged with child molestation, “There were many books I had already received. There is a presumptive principle of innocence, but it is difficult to suspend (publishing) only on charges until a verdict is issued. First of all, I couldn’t believe he did it. I thought I would be innocent, and the judgment would be good.” It is said that the writers who painted in Han’s book did not know this at all.

If he is convicted, it is possible to restrict Han’s employment in institutions related to children and adolescents, but there is no proper method for disposing of publications for children that he wrote in the past. Lee Jeong-yeon, head of the Ministry of Gender Equality and Family Child and Youth Protection, said, “It is possible to prevent convicted authors from giving lectures at schools, but there is no way to deal with previously published books.” In general, for writers who work as freelancers, employment restrictions are not particularly limited. Shin Jin-hee, an attorney at the Korea Legal Aid Corporation, who provides legal support for victims of sexual exploitation of minors, said, “It is difficult to regard a publisher as an institution that restricts employment in the case of a writer who has a publishing contract with a publisher. However, there is a problem with child sex offenders remaining as children’s storytellers.” Yasutaka Tsutsui, the original author of the Japanese animation, which has many fans in Korea, wrote a disrespectful comment on his Twitter regarding the 2017 Comfort Woman Award. Therefore The publishing company that published Tsutui’s novel in Korea decided to stop selling it immediately.Meanwhile, the contract was also canceled for the upcoming work. “After the judgment of the first trial came out, the three contracts were canceled. I stopped writing things that I had already written.” However, for books that have already been published, “These are books that came out before the conviction came out. “Isn’t there a problem with the book itself?” When asked if he would like to retrieve the books on the market, he said, “In a way, we are also victims. If there is a problem with the content, we will recover it, but the damage is too great. I am thinking of selling only the books left in the warehouse and going out of print.”

Is there an effective alternative? Park Young-sook, director of the Zelkova Tree Library in Suji-gu, Yongin-si, Gyeonggi-do, suggested a way to actively inform library users of these writers’ information. The Zelkova Library declared that it would no longer retain his books as library collections during the Tsutsui Mangeon incident. Director Park said, “I read Han’s book myself, Grooming (sex crime through tame technique) The risk seems high. “Some books are difficult to keep in the library.” He said, “Our library keeps the books of authors involved in negative issues as collections, but writes relevant information on the cover of the book so that users can know them. It can also be a way to establish a legal basis for compulsory notification of these contents in private as well as public libraries and schools.” By Choi Woo-ri, staff reporter [email protected]
