Regarding the right to preferential supply of the 2·4 housing supply measures, where controversy over property rights infringement is arising, it has decided to loosen some of the qualification criteria for projects where district designation is late. The priority supply right is a benefit for the residents of the public-led development district, and it is the right to pre-sale apartments that are newly built through reconstruction at a lower price than general pre-sale.

The standard timing of the priority supply right is the date of the announcement of the measures on the 4th.

By supplementing the standards for late business sites designated by the district

On the 8th, a government official said, “I received legal advice that the restriction of the priority supply right as of the date of the announcement of measures before the designation of the district was legitimate. It will complement the standards.”

The government has decided not to give priority to apartments and shopping malls for real estate acquired in the development district, such as the public direct implementation of the 2nd and 4th measures since the 4th, the date of the announcement of the measures. The government explained that this is to curb speculation aimed at development profits and to prevent deterioration in business feasibility caused by a sharp price hike. After the second and fourth measures, the buyer does not receive a new apartment, etc., and only receives cash compensation of the appraisal amount.

However, since the time point of the qualification criteria for the priority supply right was retroactively before the specific district designation, the controversy over property rights infringement occurred. Some point out that good faith end users who lived and purchased without expecting development could suffer damage and paralyze the old housing market. Currently, in public development projects, compensation standards such as tenant rights are usually at the time of district designation.

A government official said, “If you have lived for several years based on the date of designation, you will be able to give priority to supply.”

Even if it is purchased after the last 4 days, it is expected that if the business is late, it will be calculated from the designated date of the district and will give priority to supply if you live for a certain period. For example, if a district is designated three years after the date of the announcement of the measures, priority supply rights are given to residents of the previous three years or more from the date of designation.

In the second and fourth measures, the time point for the priority supply right was decided as the date of the announcement of the measures, which seems to have taken into account the regions where district designation will be made within the next 1-2 years due to the rapid speed of the project.
