The impeachment bill for the incumbent judge, who was first in the history of the constitution, passed through the National Assembly, and now the ball has passed to the Constitutional Court.

The issue is expected to be a serious violation of the law, and like a general trial, the parties are expected to participate in the Supreme Court of the Constitution and engage in fierce legal battles.

The resolution of impeachment prosecution, which passed the plenary session of the National Assembly, was immediately submitted to the Constitutional Court.

The first incumbent judge’s request for impeachment has been officially received.

The Constitutional Court Act stipulates that in the case of impeachment judgment, it is based on’oral defense’.

Unlike a constitutional petition judgment that can be sentenced only by a written hearing, the parties must attend and hold a’law battle’ like a general trial.

In addition, since the impeachment trial is subject to the Criminal Procedure Act, the chairman of the National Assembly’s Legislative Justice Commission becomes a prosecutor and acts as a’prosecutor’, and Deputy Judge Lim Seong-geun appears with his attorney to defend.

In a full-fledged defense, it is expected that the main issue will be whether the reason for the impeachment prosecution by Judge Lim is a’significant violation of the law’.

There were only two cases in which the impeachment of the National Assembly prosecuted the impeachment, the late President Roh Moo-hyun and the former President Park Geun-hye.

As if conscious of this, Judge Lim said that it was difficult to understand and was very sorry. He emphasized that he would fully explain that there were no violations of the Constitution and laws in the process of constitutional judgment.

Judge Lim was found not guilty in the first criminal trial, even though it was deemed unconstitutional.

If more than six out of nine judges determine that the request for an impeachment trial has a reason, Judge Lim will be dismissed.

Of course, it is a variable that the Senior Judge Lim is about to resign at the end of this month.

There is a prospect that if the constitutional decision is postponed after retirement, there is no real benefit, and thus it may be dismissed without making a separate judgment, but there are also counterarguments that there are practical benefits of judgment such as restrictions on inauguration of public offices and pension issues.
