The Constitutional Court’s judgment on whether the Law of the High-ranking Officials Corruption Investigation Office is unconstitutional comes out in about a year.
The Constitutional Court will make a decision on the case of the Constitutional Petition brought by the Future Integration Party (currently the power of the people) at 2 pm on the 28th.
Earlier, in February of last year, the Mirae Integration Party filed a constitutional petition with the intention that the entire provisions of the Airlifting Law were unconstitutional, saying that the Airlifting Act violates the principle of prosecution monopoly and separation of powers. The Constitutional Court referred this case to the All-in-One Tribunal, and received opinions from the Ministry of Justice and the Office of State Adjustment to deliberate on whether it was unconstitutional.
The ruling party revised the law so that the appointment of the chief of the airlift was delayed due to the opposition of the Future Integration Party. Rep. Sang-beom Yoo and others filed a constitutional petition for this revised law.
Meanwhile, on the previous day (27th), the Minister of Public Affairs Kim Jin-wook said to a reporter’s question about the discussion on the transfer of the airlifter in the case of the suspected illegal departure ban from Kim Hak-eui, “Tomorrow’s Constitutional Court’s decision on the Airborne Law Constitutional Petition will come out. .
“When other investigative agencies recognize a crime of a high-ranking official, the priority of the agency’s right of investigation, such as the provision to immediately notify the airlift and the right to request a case transfer, is the issue of constitutional unconstitutional screening,” he said. “(related to the transfer of the former Vice Minister Kim case) It is difficult to comment on the provisions until the constitution’s decision is made.”
