The concept of airborne first appeared in modern history in 1996, 25 years ago.
At that time, the Participation Solidarity submitted a petition for legislation for citizens of the’Anti-Corruption Act’ with the signatures of 151 opposition lawmakers and 20,000 citizens. It contained the contents of the establishment of the’High-Level Public Officials Corruption Investigation Office’ under the direct control of the president to investigate corruption activities of high-ranking public officials, but it was not legislated.
In 1997, the late former President Kim Dae-jung proposed the establishment of the’Public Office Corruption Investigation Unit’ as a pledge for the presidential election, and then promoted the establishment as a quasi-independent organization within the prosecution, but it failed.
In 2002, the late former President Roh Moo-hyun also announced the establishment of a high-ranking public officials corruption investigation office as a presidential election pledge, and after the inauguration of the participatory government, the ruling party led the initiative, but was frustrated by opposition and opposition from the prosecution.
The Lee Myung-bak administration and the Park Geun-hye administration have also been promoted in the form of a special investigative agency or a permanent special prosecution, centering on the Special Committee on Reform of the Judicial System of the National Assembly (Special Committee on Private Reform).
After these ups and downs, the promotion of airborne agencies began in earnest after the Moon Jae-in administration was launched.
President Moon, who pledged to establish an airlift in the 19th presidential election following his 18th presidential election, has taken a full-fledged drive as a key state affairs task after taking office.
In his inauguration address, President Moon reaffirmed his determination, “I will make the power institution completely independent from politics. I will create a check mechanism so that it cannot exercise any omnipresent power.”
After public debate, in April 2019, the ruling and opposition parties agreed to fast-track the reform of the election system and the establishment of airlift, and legalization began in earnest.
On December 30 of the same year, the Airlift Act passed a plenary session of the National Assembly after extreme confrontation followed by the Liberal Korean Party’s occupation of the parliamentary chairman’s office and the filibuster (interfering with legitimate parliamentary action through unlimited discussions).

However, even after legalization, it took more than a year to launch the airlift office due to the conflict between the opposition parties over the recommendation of candidates for the airlift.
According to the law, the Ministry of Public Transport had to be launched in July of last year, but the Candidate Recommendation Committee for the Minister of Public Transport was unable to select candidates due to the exercise of the veto by the recommending members of the power of the people.
In the end, on December 10 last year, the Democratic Party passed a bill at the National Assembly plenary session on the amendment of the Airlift Act to neutralize the opposition party’s veto.
After that, on the 30th of the same month, President Moon nominated Kim Jin-wook, and he is ahead of his appointment after going through the National Assembly personnel hearing procedure.
First of all, the launch of the air defense agency has historical significance in that it substantially checks the prosecutors who have exercised undeniable power based on the power of investigation and prosecution, and disperses the prosecution’s right to prosecute.
The prosecution has been monopolizing the right to prosecute criminals for 72 years since the enactment of the Prosecutors’ Office Act in 1948.
However, the monopoly system collapsed as the right to prosecute the Supreme Court and the Supreme Court Justice, the Prosecutor General, judges and prosecutors, and police officers with more than a police officer or higher was granted the right to prosecute the airlift.
The Ministry of Public Affairs is raising expectations as an alternative to increase the fairness of the criminal justice system by monitoring and checking the prosecutors who have been involved in numerous disputes over fairness while dealing with various irregularities within the prosecution or by the power class.
