Imprisonment for 20 years, fine of 18 billion won, additional fine of 3.5 billion won.
This is the price of Park Geun-hye’s Gukjeong Nongdan, finalized by the Supreme Court. On the 14th, the Supreme Court decided not to accept the prosecution’s appeal and finalized the ruling for remand of destruction. This concluded the judgment of the judiciary on Park’s crime.
Park was previously tried on charges of intervening by the Saenuri Party, and in 2018, two years in prison was confirmed. Park’s total sentence is 22 years. Considering the fact that Mr. Park has been arrested since March 2017, he will be released in 2039 if pardon or parole is not made. Currently, Park is 69 years old, and at the time of release, he is 87 years old.
Meanwhile, two of the three key figures of Gukjeong Nongdan were confirmed. Earlier, Choi Seo-won (name after Choi Soon-sil’s name changed) was finalized in the Supreme Court for 18 years in prison in June 2020, a fine of 20 billion won, and an additional penalty of 6,33676 million won. In the case of Samsung Electronics Vice Chairman Lee Jae-yong, who gave bribes of 8.68 billion won to Mr. Park and Mr. Choi, the sentence for destruction and repatriation will proceed on the 18th.
Trial ends in 3 years and 9 months
In the fall of 2016, the suspicion of Choi Seo-won’s governmental Nongdan was raised, and in December of that year, the National Assembly passed a proposal to impeach Park. Afterwards, on March 10, 2017, the Constitutional Court decided to dismiss Park, and Park was expelled from power without completing his term of office. On the 31st of the same month, Park was arrested for the third time as a former president after Chun Doo-hwan and Roh Tae-woo, and was handed over to trial on April 17.
In April 2018, the first trial court of the Seoul Central District Court sentenced Park to 24 years in prison and a fine of 18 billion won, and four months later, the appeals court of the Seoul High Court sentenced him to 25 years in prison and a fine of 20 billion won. However, the Supreme Court returned the case to the Seoul High Court in August 2019, saying that the judgment of some appeals courts, including coercion, was wrong.
Meanwhile, the case of the National Intelligence Service’s special activity expenses was tried separately from the case of Gukjeong Nongdan. This case was also destroyed and repatriated by the Supreme Court, and in July 2020, the Seoul High Court abandonment and repatriation trial court sentenced the Park Gukjeong Nongdan case and the National Intelligence Service special activity expense case together.
Park’s crimes confirmed by the judiciary are largely 14, which are largely divided into bribery and non-bribery. In the case of bribery crimes, the commission amount is large, and the’Act on Aggravated Punishment for Specific Crimes, etc.’, which regulates the aggravated punishment for bribery crimes, was applied.
Bribery crimes can be divided into four broad categories. It is a bribe from Samsung Group (8.68 billion won), Lotte Group (7 billion won), Lee Byeong-ho (200 million won), and a bribe from SK Group (8.9 billion won). The trial for repatriation of destruction was sentenced for bribery and other crimes, and out of 20 years of imprisonment, the sentence for bribery was 15 years. The violation of the exercise of ex officio abuse rights was also applied to bribery charges related to Samsung and Lotte Group.
The remaining crimes include the establishment and fundraising of Mir and K Sports, Hyundai Motor Company, GKL (a subsidiary of Korea Tourism Organization), and interfering with the exercise of ex officio abuse rights related to the’cultural blacklist’. In addition, there are attempts to force CJ Group vice chairman Lee Mi-kyung to resign, in connection with secret leaks for public affairs, and forcing Lee Sang-hwa to appoint Hana Bank headquarters.
In the case of the National Intelligence Service’s special activity expense case, except for bribery charges related to the National Intelligence Service chief Lee Byung-ki, he received KRW 3.3 billion in special activity expenses from the chief of the National Intelligence Service (National Intelligence Service) Nam Jae-joon, Lee Byung-ki, and Lee Byeong-ho, or Lee Won-jong, the head of the Blue House’s Office of the National Intelligence Service, randomly withdraws and uses the special project expenses of the National Intelligence Service.
