This is the decisive reason for Choi Mo (37), who was convicted of the ‘Iksan Yakchon 5-geori Taxi Driver Murder Case’ in Jeonbuk, where the killer turned 20 years ago, was not accused of murder. The’Yakchon 5-geori Case’, which was also the subject of the movie’Retrial’, is drawing attention. The ruling came out acknowledging the state’s liability for damages to Choi, who was framed and sentenced to prison for 10 years. Section 45 of the Civil Agreement of the Seoul Central District Court (Director Seong-ho Lee) ruled on the 13th that “The state should pay Mr. Choi about 1.3 billion won.” The judge also said to the two members of Mr. Choi’s family, “The state should pay a total of 300 million won.” Why did the court see Kim as the real culprit?

Innocent for retrial in 2016… The prosecution arrests Kim, the real criminal

At the time, the judge convicted him based on a specific statement by Kim’s friend, “The knife brought by the defendant had a curved tip, and the tip of the knife had blood and white fat in the shape of pig scaffolding.” “The day the taxi driver was murdered, the defendant wore bloody clothes and came to the house of his friend Im Mo, 400 meters away from the crime scene.”

The judge also judged Kim as the real culprit, saying, “The defendant later overturned the statement that’the knife was brought from the chicken slaughterhouse’, but he could not deny the fact that’they handed a knife with blood and fat to his friend Im Mo.’ In his final pleading at the time, Mr. Kim also appealed for resentment to the court, saying, “The real culprit in this case can still roam outside and laugh at this situation.”

Controversy over’coercion and insolvent investigation’ of prosecutors and policemen

On August 10, 2000, at about 2:7 am, Mr. Kim was convicted of stabbing a taxi driver, 42 years old, with a weapon 12 times at Yakchon 5-Fork in Yeongdeung-dong, Iksan-si, Jeollabuk-do. Initially, this case caused controversy in the investigation of insolvency and coercion by the prosecution and police.

At the time, the prosecution indicted Choi (then 16 years old), a coffee delivery man at a nearby coffee shop, on charges of murder. While Choi was driving a motorcycle, Mr. Yoo, a taxi driver, made abusive language and was infuriated and determined that he was killed with a weapon. Choi was sentenced to ten years in prison at an appeal trial in May 2001, and was sentenced to maturity in 2010.

However, even after the court’s final judgment, reports such as’there is a real criminal’ continued, and controversy about the investigation of insolvency continued. The Gunsan Police Department, which started a re-investigation in 2003, arrested two people, including Kim as the real offenders, but the prosecution did not prosecute them for reasons such as reversal of statements and lack of evidence.

Attorney Park Joon-young argues for a reconsideration of the’Samrye Nara Super Case’

Choi requested a retrial in March 2013, saying, “I made a false confession because of the coercive investigation by the police,” and the Supreme Court confirmed the retrial in December 2015. Choi’s retrial defense was made by lawyer Park Joon-young (46), who led her innocence in several retrials such as the’Three Nara Super Trio Robbery Case’. Subsequently, on November 17, 2016, the Gwangju High Court sentenced him to innocence, saying, “It is likely a false confession” at a retrial against Choi, who was charged with murder.

The prosecution arrested Jin criminal Kim in Yongin, Gyeonggi-do, four hours after he was convicted of Mr. Choi. Mr. Kim, who changed his name after the incident, denied the charges, saying, “What I stated in a police investigation in 2013 that I had’murdered’ was a story that I made up to get attention and pain to parents who did not care for me and my brothers after divorce.

The prosecution filed an arrest prosecution after reporting that Kim’s charges were acknowledged in the light of the victim’s autopsy results and statements of reference and witness. In May 2017, the Jeonju District Court Gunsan Branch, who assumed the first trial, sentenced Kim to 15 years in prison. Following the appeal trial, Kim was convicted by the Supreme Court and was sentenced to 15 years in prison.
