The adoptive parents, who are accused of abusing 16-month-old adopted child Jung In-yang for several months, leading to death, are in court this week.
According to the court on the 10th, the 13th Criminal Division of the Seoul Southern District Law (Director Judge Shin Hyeok-jae) was charged with the mother-in-law of the mother who was arrested for violation of the Child Abuse Punishment Act (child abuse mortality) on the 13th, and violation of the Child Welfare Act (child abandonment and neglect). The first trial of Mr. Ahn, the adoptive father, is held.
Jang was handed over to trial on charges of repeatedly assaulting and abusing his daughter Jeong In-yang, adopted from June to October of last year, and inflicting a strong shock on such parts as October 13th.
He is also accused of emotionally abusing Jung In-yang alone in a house or car on 15 times last year from March to October, or pushing a stroller to bump into an elevator wall.
Her husband, Ahn, who did not take any action even after recognizing Jang’s abuse and worsening Jung In-yang’s health condition, was also prosecuted for imprisonment.
According to the prosecution, Jeong In-yang died of abdominal damage caused by a strong shock to the back. However, since it is not known how the shock was inflicted in detail, the prosecution applied only the charges of child abuse and lethality, not murder, and handed it over to trial.
However, as the prosecution recently requested a reappraisal of the cause of Jung In-yang’s death to professional autopsy doctors, interest is also focused on whether the murder charge will be applied additionally.
If murder charges are applied, Jang’s sentence is expected to increase significantly. According to the Supreme Court’s sentencing criteria, the basic sentence for murder is 10-16 years, and if a weighting factor is given, a medium sentence of more than a weapon can be sentenced. On the other hand, in the case of child abuse fatalities, the standard of sentencing is relatively low, with a basic 4-7 years and a weighted 6-10 years.
Meanwhile, as the case is re-examined through the broadcast, citizens are filing hundreds of petitions to the court and sending a garland in front of the prosecutor’s office, demanding strict punishment from Mr. Jang.
However, the judge said, “There is a concern that it will affect the judgment,” and “I will not see the petition until it is judged guilty or innocent.”
